The XLR8+ Labs Australia mobile message service (the "Service") is operated by XLR8+ Labs Australia ("XLR8+ Labs Australia", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to XLR8+ Labs Australia's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of XLR8+ Labs Australia through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with XLR8+ Labs Australia. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to XLR8Labs or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other XLR8+ Labs Australia mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

1. Who we are

XLR8+ Labs ("we", "us", "our") is an Australian business, ABN 23 692 150 566, operating xlr8-labs.com.

2. Using our site

You agree to use the Site only for lawful purposes and not to:

  • Attempt to interfere with the Site's security or functioning
  • Use automated tools to scrape or copy Site content without permission
  • Post or transmit anything unlawful, misleading, or infringing on others' rights

We may suspend or restrict access to the Site for anyone who breaches these Terms.

3. Products and health disclaimer

XLR8+ Labs sells nasal strips and mouth tape designed to help reduce nasal airway resistance, which many people find makes breathing feel easier.

  • Our products are not medical devices, and are not intended to diagnose, treat, cure, or prevent any disease or medical condition, including sleep apnoea.
  • If you have a pre-existing medical condition, a skin sensitivity, or any concerns about your breathing, consult a healthcare professional before use.
  • Always follow the instructions on the product packaging. Discontinue use and seek medical advice if you experience irritation or discomfort.
  • Individual results vary. Nothing on this Site constitutes medical advice.

4. Orders and pricing

  • All prices are listed in AUD and include GST where applicable, unless stated otherwise.
  • We take reasonable care to ensure product and pricing information is accurate, but errors can occur. If we discover a pricing or listing error after you've placed an order, we'll contact you before proceeding, and you can choose to continue at the correct price or cancel for a full refund.
  • We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or stock unavailability.

5. Payment

Payment is processed securely through Shopify's payment gateway at the time of order. We don't store your full card details.

6. Shipping and delivery

Shipping timeframes and costs are provided at checkout. We aren't responsible for delays caused by couriers or events outside our reasonable control, but we'll do our best to keep you informed if your order is delayed.

7. Returns and refunds

Our Return & Refund Policy forms part of these Terms. Nothing in these Terms or our Return & Refund Policy limits your rights under the Australian Consumer Law.

8. Intellectual property

All content on this Site — including the XLR8+ Labs name, logo, XLR8-Grip Technology branding, product photography, and written content — is owned by us or licensed to us, and may not be copied, reproduced, or used commercially without our written permission.

9. Limitation of liability

To the maximum extent permitted by law:

  • We provide the Site and our products on an "as is" and "as available" basis.
  • We aren't liable for any indirect, incidental, or consequential loss arising from your use of the Site or our products.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it's limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid.

10. Third-party links

Our Site may link to third-party sites (e.g. social media, research sources). We aren't responsible for the content or practices of those sites.

11. Changes to these Terms

We may update these Terms from time to time. Changes take effect once posted on this page. Continuing to use the Site after changes are posted means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
